By accessing or using Tend ("the App"), you agree to be bound by these Terms of Service. If you disagree with any part of the terms, you may not access the service.

2. Use of the Service

Tend is designed to be a plant care companion. You agree to use the App only for lawful purposes. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

3. AI Services and Disclaimer

The App relies on third-party artificial intelligence to identify plants and provide care advice. While we strive to provide helpful information, we do not guarantee the accuracy, completeness, or reliability of any AI-generated content.

Plants are living things, and their care depends on many factors. The advice provided by Tend should not override your own observation and judgment. We are not liable for any plant damage or loss resulting from the use of our Services.

4. AI Credits and Payments

Certain features, such as plant identification and automated care advice, require the expenditure of "AI Credits."

• Credits can be purchased within the App securely via Stripe.
• All purchases are final and non-refundable, except as required by law.
• Credits have no monetary value outside of the Tend ecosystem.

5. User Content

You retain your copyright to any images or data you upload to the App. However, by uploading content, you grant Tend a worldwide, non-exclusive license to use, store, and process your content specifically to provide and improve the App's services, including transmitting images to our AI provider APIs.

6. Modifications to the Service

We reserve the right to modify or discontinue, temporarily or permanently, the Service (or any part thereof) with or without notice. Prices of AI credits are subject to change.
